Six countries, the same five dimensions.

Each country was built with the Chile corpus method: the full universe of contracts and, for each one, the documents in five dimensions — contract, performance, amendments, disputes and financial information — taken from the official sources that publish them, in their original language.

In Chile, the inspection reports published by the Ministry of Public Works start in 2015, so concessions that ended earlier have no performance documents. Disputes count Technical Panel cases, arbitrations and court rulings linked to a contract.

What is not published is reported too. In France and Greece, the State's PPP contracts (schools, hospitals, prisons) are not published in signed form.

In Peru, the contracts for Lima's urban transport are not published; outside OSITRAN, financial information is limited to listed companies.

In South Korea, arbitrations are not public and court rulings are anonymised: there are 45 rulings across 20 projects.

In Brazil, ports have little financial information per terminal, and some official sources do not allow automated access.

The most complete record: six sources, measured against each institution's own catalogue.

133 public-works concession contracts, assembled contract by contract: the 130 with a project page on the Ministry of Public Works site plus 3 awarded concessions that were terminated before execution. 30,651 unique documents, 447,151 passages and 153.9 million words, all with provenance.

Question 01 · Tariff regulation

How are tolls adjusted on concession motorways?

In all six countries the toll is indexed to inflation once a year. Everything else differs:

  • How inflation passes through: in full in most countries; in France, as a fraction plus a fixed component; in Korea, as a ceiling on the increase.
  • Whether there is a real or productivity component: Chile's real adjustment and Brazil's X Factor.
  • Who decides: the concessionaire sets and notifies in Korea and Greece; the regulator authorises in Brazil; the State approves by decree in France and Chile.
  • How new works are paid for through tolls: additional increases in France, increases agreed in amendments in Chile, a review of the base tariff in Brazil.

Question 02 · Renegotiations

How often is a concession motorway renegotiated, and why?

In Chile, France, Brazil and Peru, the most-amended motorways have between 11 and 46 amendments. In South Korea and Greece there are fewer. The reasons recur from one country to the next: unforeseen new works, paid for with term, tolls or State funds; rebalancing after regulatory changes or changes to the tariff rule; refinancings; extensions and changes of control; and compliance with arbitral awards or audit-court orders.

The units are not equivalent: in Greece only amendments that reach statute are counted, and in Chile and France a single amendment can bundle several works. They show order of magnitude and instrument, not a ranking.

What drove the renegotiations: one example per country

Chile. Because of el nivel de deterioro que presenta el Puente Maipo (the deterioration of the Maipo Bridge) two new structures are built, and el MOP otorgará a la Sociedad Concesionaria un mayor plazo de concesión de 12 meses (the Ministry grants the concessionaire a 12-month extension) as compensation.Supreme Decree 380/2014, pp. 3–4; Supreme Decree 150/2019, p. 8 · Autopista Central

Peru. Red Vial 6's sixth addendum serves, among other things, implementar lo resuelto en el Laudo Arbitral del Caso N° 2474-2012-CCL (to implement the arbitral award in case 2474-2012-CCL) and to bring forward second-stage works.Addendum 6, Red Vial 6, p. 4

How other countries solved it

For ministries of finance, PPP units, grantors and regulators designing or renegotiating a contract: how the other five countries handled a clause, a renegotiation or a dispute — revenue guarantees, rebalancing, tariff regulation, early termination — compared, with the source of every statement.

The record of a market or a contract

For lenders, investors and counsel assessing a country or an asset: a contract's full amendment history, its disputes and its financial statements, or the documentary landscape of a market before tendering or investing in it.

The evidence base of the platform

The Chile corpus is the ground on which the Austral Platform's contract modules are built and tested: the contract ledger, the classification of modifications and renegotiations, and the benchmarks that a new project is measured against.
